Terms of Use

These terms cover your use of Bitbook, a stand-up comedy notebook for Apple platforms, made and published by Sammy Gutiérrez, an individual developer. “Bitbook” below means the app and, where it acts, me. By installing or using the app, you agree to these terms. If you don’t, please don’t use the app.

The Short Version

• You can use Bitbook on your Apple devices. It is free.
• Your jokes and content are yours. Bitbook doesn’t claim any rights to them.
• The app is provided as-is, with no promise that it’s bug-free.
• Don’t copy, resell, or reverse-engineer the app, except where the law allows it.

License to Use Bitbook

You get a personal, non-exclusive, non-transferable license to install and use Bitbook on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may not sell, rent, sublicense, or redistribute the app, or reverse-engineer, decompile, or extract its source code, assets, or design, except to the extent applicable law expressly permits it despite this restriction. You must be at least 13 years old, or the minimum age required in your country, and if you are under the age of majority where you live, you may use the app only with the involvement of a parent or guardian. You can stop using Bitbook at any time, the app may be discontinued at any time, and these terms continue to apply to your past use.

Apple’s Standard EULA

Bitbook is distributed through the App Store under Apple’s Standard End User License Agreement, which applies alongside these terms. Where the two overlap, the stricter applies. Apple is a third-party beneficiary of these terms and may enforce them against you.

Your Content

Everything you create in Bitbook belongs to you, and Bitbook claims no ownership of it. You are responsible for it: for having the right to record the audio or video you capture, for getting consent where the law requires it, and for what you choose to share. Do not use the app to violate any law.

Feedback

If you send a suggestion, feature request, or bug report, I may use it to improve Bitbook without any obligation to you and without owing you compensation or credit. Please do not send anything confidential.

Price

Bitbook is free, with no in-app purchases and no subscriptions. Downloading it from the App Store is subject to Apple’s own terms.

Disclaimers

Bitbook is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. There is no guarantee that the app will be uninterrupted or error-free, or that data loss will never occur. Back up your work. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Limitation of Liability

To the maximum extent permitted by law, Bitbook is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the app. Total liability for any claim related to the app is limited to the amount you paid for it, which is zero. Nothing in these terms limits or excludes liability that cannot be limited or excluded under the law that applies to you, including liability for death or personal injury caused by negligence, for fraud, and for your rights as a consumer under mandatory local law.

Disputes and Governing Law

If you have a problem, email sammy@bitbook.lol first. Most things are a misunderstanding or a bug, and both are faster to fix directly than formally. These terms are governed by the laws of the State of Arkansas in the United States, without regard to its conflict of law rules. If you use Bitbook as a consumer, nothing here takes away the protections of the mandatory law where you live, or your right to bring a claim there or in small claims court.

Changes and Other Terms

If these terms change, the updated version will be posted here with a new “Last updated” date, and continued use of the app after that means you accept them. If any part of these terms is unenforceable, the rest stays in force. These terms, Apple’s Standard End User License Agreement, and the privacy policy are the entire agreement between you and Bitbook about the app. Questions go to sammy@bitbook.lol.
